Chapter One: Introduction
1.1 Background of the Study
In Nigeria, traditional rulers have played a central role in governance, particularly at the local level. However, the increasing prominence of constitutional law in regulating political and social structures has raised questions about the influence of traditional rulers in contemporary governance. In Gombe LGA, traditional rulers are integral to the socio-cultural dynamics and often serve as custodians of community values and traditions. Constitutional law, particularly in relation to local governance, has limited the powers of traditional rulers in areas such as lawmaking, administration, and electoral processes (Bala & Mohammed, 2023). This study aims to examine how constitutional law impacts the authority of traditional rulers in Gombe LGA, considering the balance between constitutional principles and traditional practices.
1.2 Statement of the Problem
The relationship between constitutional law and traditional authority in Gombe LGA remains a topic of debate. While constitutional law aims to establish a framework for democratic governance, traditional rulers continue to exert influence over local affairs. This study will evaluate how constitutional provisions affect the powers and authority of traditional rulers in Gombe LGA, addressing the challenges of maintaining a balance between traditional and modern governance structures.
1.3 Objectives of the Study
To evaluate the impact of constitutional law on the authority of traditional rulers in Gombe LGA.
To explore the role of traditional rulers in local governance and how it intersects with constitutional law.
To propose recommendations for harmonizing constitutional law with traditional governance structures in Gombe LGA.
1.4 Research Questions
How has constitutional law impacted the authority of traditional rulers in Gombe LGA?
What is the role of traditional rulers in local governance within the context of constitutional law?
What measures can be taken to strengthen the relationship between constitutional law and traditional governance in Gombe LGA?
1.5 Research Hypothesis
H₁: Constitutional law has reduced the authority of traditional rulers in Gombe LGA.
H₂: Traditional rulers continue to play a significant role in local governance, despite constitutional restrictions.
H₃: A more cooperative framework between constitutional law and traditional governance will enhance local governance in Gombe LGA.
1.6 Significance of the Study
This study will provide insights into the dynamic between constitutional law and traditional leadership in Nigeria. It will contribute to the broader conversation on the role of traditional rulers in modern governance and help policymakers develop strategies for harmonizing legal and traditional frameworks.
1.7 Scope and Limitations of the Study
The study will focus on the effect of constitutional law on traditional rulers’ authority in Gombe LGA, Gombe State. Limitations may include difficulties in accessing information from traditional institutions or reluctance from community leaders to discuss the potential conflict between traditional and constitutional systems.
